These Terms of Use ("Terms") govern your access to and use of all websites, software, applications, content, products and services ("Services") operated, managed or licensed by Panelhub OU ("Company", "we", "us", "our"), including the website myspots.app ("Site").
By accessing or using our Site or Services, you ("User", "you", "your") agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use our Site or Services.
We may update these Terms from time to time. Any material changes will be communicated via email or on our Site before taking effect. Continued use of our Services after such notification constitutes your acceptance of the updated Terms.
Our Services include the operation of online panels and survey platforms for market research purposes, as well as participation in studies, polls, and related activities ("Activities"). Certain Services may be subject to additional guidelines or rules, which will form part of these Terms.
Membership of our respondent panel ("Panel") is open only to individuals aged 16 years or older who are residents of Estonia or other approved regions listed on our Site.
To join our Panel, you may be required to register an account and provide accurate, complete, and up-to-date information. Only one Panel account per person and unique email address is permitted.
By registering, you agree to receive emails relating to surveys, studies, and panel operations. You are responsible for maintaining the confidentiality of your login credentials. Any activity occurring under your account will be deemed to have been carried out by you.
Panelhub OU reserves the right to suspend or terminate any account at its sole discretion, including in cases of suspected fraudulent, abusive, or misleading behaviour.
Participation in any survey or Activity is entirely voluntary. Not all users will qualify for every survey, and completion does not guarantee compensation.
If compensation is offered, the details will be specified in the survey invitation. Rewards will typically be credited to your account or issued within 30 days of survey completion unless stated otherwise.
You are solely responsible for any tax liabilities arising from rewards received. Panelhub OU accepts no liability for lost or misused compensation due to failure to safeguard your account details.
Panelhub OU processes personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) and applicable Estonian data protection laws.
By using our Site or Services, you acknowledge and consent that your personal information, including personally identifiable information ("PII"), may be collected and shared with our trusted third-party partners, such as clients, service providers, or data processors, for legitimate business purposes including:
Market research and analysis;
Survey administration and incentive fulfilment;
Quality control and fraud prevention.
All such third parties are contractually bound to handle your data strictly under our instructions and in compliance with applicable data protection laws.
We do not sell your personal data. We shall not be liable for the processing of your data by any authorised third party acting in accordance with these Terms and our Privacy Policy.

You agree not to engage in any of the following prohibited acts:
Disrupting or interfering with the operation or security of the Site or Services;
Using automated tools (robots, spiders, etc.) to collect data or manipulate survey results;
Posting or transmitting unlawful, defamatory, obscene, or harmful content;
Engaging in fraudulent behaviour (including multiple account creation or false survey data);
Attempting to access another user's account without authorisation;
Reverse-engineering or modifying any part of the Site or Services.
Violation of these rules may result in immediate suspension or termination of your account without notice.
You may be able to upload or submit content such as text, images, or feedback ("User Content"). You retain ownership of your User Content but grant Panelhub OU a non-exclusive, worldwide, royalty-free licence to use it solely for operating, improving, and promoting our Services.
You warrant that your User Content:
Does not infringe any third-party rights;
Does not violate any law; and
Does not contain offensive or harmful material.
Panelhub OU reserves the right to remove or moderate User Content at its discretion.
All materials, logos, trademarks, and content available on our Site or through our Services are the property of Panelhub OU or its partners. You may not reproduce, modify, distribute, or use any such materials without our prior written consent.
Our Site and Services are provided on an "as is" and "as available" basis without any warranties, whether express or implied. We do not guarantee uninterrupted access, accuracy, or completeness of the information provided.
Some jurisdictions may not allow the exclusion of certain warranties; in such cases, those exclusions may not apply to you.
To the maximum extent permitted by law, Panelhub OU and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages, loss of profits, or loss of data arising from your use of the Site or Services.
Our total liability to you for any claims arising from these Terms shall not exceed the total amount of compensation paid to you through our Services.
Nothing in these Terms limits or excludes any liability that cannot be excluded under Estonian or EU consumer law.
You agree to indemnify and hold harmless Panelhub OU, its officers, employees, and affiliates from any claims or damages arising out of your use of the Services, your breach of these Terms, or your violation of any applicable law or third-party rights.
We shall not be liable for any failure to perform our obligations where such failure results from events beyond our reasonable control, including acts of God, war, terrorism, natural disasters, pandemics, or governmental restrictions. Where possible, we will notify you of any such events and their expected duration.
Panelhub OU may suspend or terminate your access to the Site or Services at any time and without prior notice if you breach these Terms or engage in conduct deemed inappropriate. Provisions that by their nature should survive termination shall continue in full force and effect.
These Terms shall be governed by and construed in accordance with the laws of Estonia.
If you are a consumer resident in another EU country, you may also be entitled to bring proceedings in your home jurisdiction under applicable consumer protection laws.

You may not assign or sublicense any of your rights or obligations hereunder, in whole or in part, by operation of law or change in control of you or otherwise, unless you obtain our prior written consent. We are free to assign all of our rights and obligations hereunder, and upon such assignment we will be relieved of all liability under these Terms, and all rights and obligations shall accrue to the successor or assignee. These Terms are binding upon and inures to the benefit of our successors and assigns and your permitted successors and assigns.
If we are unable to perform any of our obligations hereunder (including without limitation loss of or failure to provide the Services) due to any event beyond our reasonable control, including without limitation, acts of God; acts of terrorism, war or the public enemy; flood; earthquake; tornado; storm; fire; pandemic or epidemic; civil disobedience; insurrections; riots; labor disputes; labor or material shortages; sabotage; restraint by court order or public authority (whether valid or invalid); acts or omissions of any government or agency thereof; power or telephone failures; or breakdown or malfunction of machines, transportation facilities or other equipment of any nature, then our performance shall be excused for the period of such event, but we will use our best commercial efforts to limit the duration of any such delay.
These Terms and the legal relations among the parties shall be governed by, and construed and enforced in accordance with, the laws of Estonia, without regard to principles of conflicts of laws. You expressly agree that exclusive jurisdiction for any dispute with Company, or in any way relating to your use of the Sites or the Services will be decided by a court of law sitting in Estonia.
Titles and paragraph headings are for reference purposes only. These Terms contain the entire | agreement of both parties, and supersedes any and all previous oral and written | communications and agreements with respect to the subject matter hereof. Any of our | remedies are cumulative and not exclusive. No waiver of any breach of any provision of these | Terms is a waiver of any prior, concurrent or subsequent breach of the same or any other | provision hereof and no waiver shall be effective unless made in writing. If any provision of | these Terms is found to be invalid or otherwise unenforceable, the validity of any remaining | portion shall not be affected and the remaining portions shall remain in full force and effect, as if | invalid portions were deleted from these Terms.
Individuals are invited to join our panel to participate in Activities (including but not limited to | market research, studies and other surveys). (the "Panel").
By signing up to join our Panel, you agree to receive invitations to participate in surveys and | research programs. To unsubscribe from panel membership at any time, please see "Opt-Out | Policy" below.
Only one panel membership is permitted per unique email address.
1. Panel Registration | As a condition to using the Sites and Services, you may be required to register and join the Panel | as a member. If you register for a Service, you agree to receive emails from us related to the | Sites and the Services. You agree to provide and maintain accurate, current, and complete | information, including your contact information for notices and other communications from us | and information that we need from you in order to pay any incentives for your participation (if | applicable). Failure to do so shall constitute a breach of this Agreement, which may result in | immediate termination of your account. We will handle any personal data you provide in | accordance with our Privacy Policy. | A Panel membership is personal and may only be used by the registered individual. | You may not (i) register with a pseudonym or a name of another person with the intent to | impersonate that person; (ii) use a name subject to any rights of another person without | appropriate authorization; or (iii) misrepresent your licenses or qualifications. Company reserves | the right to refuse registration of or cancel a Panel Member at our sole discretion. You are | responsible for maintaining the confidentiality of your password and are solely responsible for | all information and instructions transmitted through the Sites or the use of any Services. All | information and instructions communicated by use of your Account, whether authorized or | unauthorized, will be considered to have been sent and authorized by you. You agree to | promptly notify us of any unauthorized use of your account, or of any other breach of security | that you become aware of involving your account or the Services.
2. Conditions for Participation in a Survey or Other Research Programs | Participation in a survey or other research service is entirely voluntary. When you participate in a | survey or other research program, and/or use our Site, you are obligated to comply with these | Terms, as well as any other terms and conditions that apply to your participation. If you do not | qualify for a survey or other research program, you will not receive any possible compensation | for your participation. | We may at any time refuse to provide the Services to anyone at our own discretion. Online | surveys are first come, first served and spots cannot be reserved; the survey will close when | quotas have been met.
3. Compensation | If you respond to and successfully complete a survey or participate in another research program, | you may be offered compensation for your time. Full details of compensation will be included in | each survey invitation. | We do not accept any liability or responsibility for any tax consequences or duties that may | occur as a result of any compensation paid. Breach of these Terms may result in loss of | compensation which you have earned. | You are responsible for protecting your password and log in details. Panelhub OU accepts no | liability where a loss of compensation has occurred due to loss or failure to safeguard your log in | information.
4. Opt-Out Policy | Panel members may opt-out from using any or all Services (including, without limitation, from | receiving survey invitations, newsletters or communications) at any time by: (a) following the | unsubscribe procedures described on the relevant Site or contained in an email received from | us; or (b) by sending an email to our team – [email protected]
